Properly speaking, the Chief Counsel should (I'd like to say must, but nothing is ever that certain) defer to the technical experts and departments since this kind of issue is decided by examining the technicalities, not the legalities, of the situation. It would be perverse indeed for the Chief Counsel to write or suggest anything that is contrary to what is in that memorandum.
