Drunken Flying Plea-WTF?

U.S. statutes grant the FAA the authority to fine anyone, including non-certificated pilots, for violating FAA regulations. So in theory this guy could now also get fined by the FAA.

First there is the one all-important prerequisite to establish: he "pleaded no contest to operating an aircraft," so it is now (presumably) legally established he was operating an aircraft (I'll have to look into this; many Bimmers are cheaper than many old airplanes.)

After that there are a couple of possible choices: 91.13(a) or (b), careless or reckless operation, or 91.17 alcohol or drugs.

Yeah, I know it is something of a stretch, but I expect Eric Holder to be made head of the FAA any day now.... :hairraise:
